  1. COPY RIGHTS and LICENSE SUMMARY.

  3. The programs of "*TALO's TEXT PROOF READER, XPROOFER" (which term as 
  4. used herein shall include the set of machine readable material on magnetic 
  5. media, the user documentation, and any other related material delivered
  6. to the Customer by or on behalf of *TALO), as well as the related copy rights
  7. or other industrial or intellectual property rights are the property of 
  8. *TALO. The customer acquires no title, right or interest in the program other 
  9. than the license rights granted by the confidentiality and license agreement.
  10.  
  11. Except for the demonstration version of the program, the program shall only 
  12. be used by persons and institutes who have agreed with *TALO's license 
  13. agreement.
  14. The demonstration version of the program shall only be unpacked for the very
  15. first time and executed for the purpose of evaluation during period of 30 days 
  16. after having obtained the demonstration version in a legal way. 
  17.  
  18. The program is delivered to the customer on a confidential basis and the 
  19. customer is responsible for taking all steps necessary to ensure the  
  20. continued proprietary and confidential nature of the program. In
  21. particular the customer shall keep in confidence and not disclose or otherwise 
  22. make available the program to any third party, other than the customer's 
  23. employees for the use permitted under the accompanying license agreement, 
  24. without the prior written permission of *TALO.
  25. However, the original demonstration package, as it was shipped to you, may be 
  26. redistributed to any third party under the same obligations and the same rights
  27. which were originally existed. This redistribution of the demonstration version
  28. should be considered as having obtained the demonstration version directly
  29. from *TALO.
  30.  
  31. The customer shall not remove from the program any trademark, tradename, 
  32. copy right notice or other notice, and shall be responsible for their
  33. conservation on the copies received under the accompanying confidentiality
  34. and license agreement and for their reproduction on any backup copy of 
  35. the program.
  36.  
  37. The customer shall not to change or translate the programs without prior 
  38. permission of *TALO.
  39.  
  40. The customer may copy, in whole or in part, the program in machine readable 
  41. form on another magnetic medium, only in those cases in which this should prove
  42. necessary for back-up and recovery in case of a breakdown, provided however 
  43. that such copies shall be used solely on the original machine.
  44.  
  45. The customer may not copy, either in whole or in part, the documentation
  46. provided by *TALO for the use of the program and any other printed material 
  47. supplied by or on behalf of *TALO to the customer.
  48.  
  49. Additional copies of this documentation may be supplied by, or on behalf of,
  50. *TALO at its rates in force at the time of ordering.
  51.  
  52. The customer shall not rent or lease the programs and the documentation.
  53.  
  54. *TALO gives no warranties with respect to the program licensed hereunder and
  55. all implied warranties, including warranty of merchantability and fitness 
  56. for purpose, are hereby excluded.
  57. IN NO EVENT WILL *TALO OR ITS SUPPLIERS BE LIABLE FOR INDIRECT, CONSEQUENTIAL, 
  58. INCIDENTAL OR SPECIAL DAMAGES.
  59. The programs are solely supplied "as is".
